My guest, Luke Zimmerman, of the Law Offices of Luke Zimmerman APC, filed the first state cannabis trademark on Jan 2, 2018, followed by many more applications since then. Luke is one of those hip, bearded, college professor type guys that knows exactly how to relate cannabis to IP law because he has been studying, watching and waiting for when these 2 paths collide, and they are colliding my friends. While editing and getting this week’s episode ready, the first cannabis patent lawsuit was filed by United Cannabis Corporation. While this episode doesn’t go too into detail about plant patents, we do go into detail about how and where IP law applies in the cannabis industry - from trademarking strain names(CULTIVARS), to why you want to do some due diligence on your lawyer before they file federal trademarks for you(hint - YOU CAN’T FILE FEDERAL TRADEMARKS FOR CANNABIS TOUCHING PRODUCTS), how apples, roses and cannabis have a lot in common patent-wise, and more!
